A federal judge has thrown out the criminal charges against former FBI director James Comey and New York Attorney General Letitia James. The judge ruled that the prosecutor who initiated the cases at the behest of President Donald Trump was unlawfully appointed by the Justice Department.

Despite dismissing the cases against Comey and James, the judge did not bar the Justice Department from refiling the charges.
Both Comey and James had requested the cases to be dismissed with prejudice, preventing their revival by the Justice Department. However, the judge opted for dismissal without prejudice, leaving open the possibility for future prosecution attempts.
In response to the ruling, Comey expressed his views through a social media video, emphasizing the importance of preventing the abuse of executive power to target political opponents. The legal teams for Comey and James argued that the appointments and subsequent prosecutions were driven by vindictiveness.
The challenge to Halligan’s appointment was part of a broader attack on the indictments by Comey and James, who alleged the cases were retaliatory. The Justice Department has indicated plans to appeal the judge’s decision and may seek to reintroduce the cases.
Comey, a former FBI director, had clashed with Trump over the Russia investigation, leading to his dismissal in 2017. Meanwhile, James had secured a significant judgment against Trump in a fraud lawsuit. Although the fines were overturned, James remains resolute in her commitment to advocating for New Yorkers.
